~ DECLARATION OF COVENANTS & RESTRICTIONS ~

P.O.A. - Each owner of a lot in The Palms Subdivision shall be a member of The Palms Subdivision Property Owners Association (POA)
No building or structure of any kind whatsoever other than a single dwelling shall be erected on the property, and any such dwelling house shall be used for residential purposes only. An exception for a detached multi-car garage may be made by the developer.
All homes must contain at least 1,900 heated square feet, with a minimum 1,200 square foot footprint, unless approved in writing by the Architectural Committee. Also, all homes must have an attached two-car garage and all garage entrances must be side or rear entry and not visible from the street. If the shape or size of any lot prohibits this garage construction requirement, then other options may be approved by the Developer of the POA. All driveways must be either pavement or concrete.
All building and landscape plans must be approved by the developer before start of construction, further there shall be a committee established by the POA with regard to architectural approval for new construction.
No lot shall be used for access to an adjoining property without the written consent of the owner and developer.
There will be no subdividing of any lots within the subdivision.
No lot may be used for vehicle repair work whether performed by the property owner or other parties. All R.V.'s, campers, and boats and equipment utilized with boats, including trailers, shall be kept out of view from all others.
Residents and property owners shall not be allowed to park vehicles on the road except in emergencies. Unless otherwise posted, guests and visitors of owners may park on the shoulder of the roads, only while visiting property owners for a short duration, so long as the health, safety, and convenience of other residents within the subdivision are not impaired.
No sign of any kind shall be displayed to the public view on any lot, except one sign identifying the property owner. The maximum size of any permitted sign shall not exceed four square feet.
Any residential construction started, including outbuildings, must have the exterior completed within a reasonable amount of time, not to exceed thirty-six months from the date of the deed for the lot was recorded at the office of the Register of Deeds for Rutherford County, North Carolina.
No animals, livestock or poultry of any kind shall be kept, raised, or cred on the property, except that of dogs, cats, or other common household pets may be kept so long as the owner of such animals do not keep, breed, or maintain such animals for any commercial purposes.
All buildings shall be constructed with high quality materials and workmanship to insure that no dwelling will present any unsightly appearance. The following exterior surfaces/finishes are unacceptable: (1) Asbestos shingle siding, (2) Vinyl or any plastic siding, (3) Aluminum or any metal siding, and (4) Exposed concrete block, except approved architectural grade blocks with finish.
No modular or mobile homes of any type or description shall be permitted, only "stick built" homes are allowed.
Above ground swimming pools are prohibited. All in ground pools must be fenced.
